Chapter 54

Control of State Institutions

Appointments, the judiciary, enforcement agencies, electoral machinery and federal relations, computed for whoever controls each instrument: the UPA, the NDA and every state government.

The 8 figures in this chapter are reproduced from the report of Atlas research module M8, with the passage of the study that explains each. They keep the study’s own labels and colours: RW denotes the Hindutva-aligned bloc and LW the coalition that contests it (see A Note on Terms).

State samples are small, curated and not a census. They show the direction is the same for every party that controls an agency; the scale differs because the Union agencies have national jurisdiction and the PMLA's bail and burden-of-proof provisions (upheld in Vijay Madanlal Choudhary, 2022).

CBI general consent has been withdrawn by 13 states, all under the NDA: Mizoram (INC, 2015, first), WB (AITC), AP (TDP, after leaving the NDA), Chhattisgarh, Rajasthan, Punjab and Karnataka (INC), Maharashtra (MVA), Kerala (LDF), Jharkhand (JMM), Telangana (BRS), TN (DMK) and Meghalaya (NPP, an NDA ally). No UPA-era withdrawal was found. In 2010 a Constitution Bench held that courts can direct CBI probes without state consent. On 2 Jan 2025 the SC held that the CBI does not need state consent to register cases in some categories (M8_cbi_consent.csv).
