The India Power Atlas
Part VIII · The State
Chapter 35

The Judiciary

Arena 7.7 · weight 3 · reading 43.5 · opposed majority

35.1Scope

The final veto.1

The arena is measured by high-significance rulings on contested issues (significance-weighted), the 2024-26 trend, and judges’ post-retirement posts.

Principal evidence: Supreme Court and High Court rulings on contested issues (220 coded, decided 2004-26, most since 2019): the Hindutva position prevailed in 38 of the 85 high-significance rulings that had a clear winner (47 went the other way; 18 more were mixed or consensus). Across all 171 rulings with a clear winner: 88 vs 83 (Atlas M8).

35.2Significance

Outlasts governments; not won at elections.

35.3Indicators and weights

Table 35.1 lists the 3 indicators of the arena, the weight of each within the arena, and each indicator’s reading (the Hindutva-aligned share, from 0 to 100).
